Use of Chocoberry is subject to these terms.

1. Acceptance

By accessing or using Chocoberry, you agree to these terms. If you do not agree, do not use the service.

2. The service may change

Chocoberry is an evolving AI storytelling service. Features, limits, plan structure, availability, models, and interfaces may be added, removed, restricted, interrupted, or changed at any time without any obligation to continue a particular feature or level of service.

3. Eligibility and acceptable use

You may not use Chocoberry in violation of applicable law, to infringe rights, to abuse the service, to attempt unauthorized access, or to submit or generate content that the service prohibits. Chocoberry may suspend, limit, or terminate access at any time if use appears risky, unlawful, abusive, or otherwise inconsistent with operation of the service.

4. User content and AI output

You are responsible for prompts, messages, characters, scenes, and other content you submit. You grant Chocoberry a non-exclusive license to host, process, transmit, modify, and use that content as needed to operate, secure, maintain, improve, and enforce the service.

AI output may be inaccurate, incomplete, fictional, offensive, unsafe, repetitive, or otherwise unsuitable for your purpose. Output is provided for entertainment and general informational purposes only and should not be relied on as fact, advice, or a substitute for professional judgment.

5. Accounts, subscriptions, and billing

Some features may require an account or paid subscription. Billing, renewals, taxes, and payment processing may be handled by Paddle and other service providers. By purchasing a subscription, you authorize recurring charges according to the plan shown at checkout unless and until canceled.

Prices, billing intervals, taxes, features, entitlements, and eligibility may vary by region, account state, promotion, or service changes. Checkout disclosures control for the transaction presented to you.

6. Suspension, termination, and removal

Chocoberry may suspend, restrict, delete, or terminate accounts, content, subscriptions, or access at any time, with or without notice, including for risk management, abuse prevention, legal compliance, inactivity, unpaid charges, service changes, or other operational reasons.

7. No warranties

To the maximum extent permitted by law, Chocoberry is provided “as is” and “as available.” Ani Talakhadze disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranty of availability, performance, non-infringement, merchantability, fitness for a particular purpose, accuracy, quality, title, data retention, or security.

8. Limitation of liability

To the maximum extent permitted by law, Ani Talakhadze will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or loss-based damages, or for loss of profits, revenue, business, goodwill, data, or content, arising out of or related to Chocoberry.

To the maximum extent permitted by law, the total aggregate liability of Ani Talakhadze for any claim arising out of or relating to Chocoberry will not exceed the greater of the amount you paid to Chocoberry in the twelve months before the event giving rise to the claim or USD $50.

9. Changes to these terms

These terms may be updated from time to time by posting a revised version on this page. Continued use of the service after an update means the updated terms apply to your subsequent use.
